Process Times

PHASE 1

Immigrant Petition (Form I-526E)
RESPONSE TIME

Estimated processing time: Approximately 12–18 months. You submit Form I-526E to USCIS with evidence of your qualifying investment and lawful source of funds. Approval confirms your eligibility for the EB-5 visa.

PHASE 2

Conditional Permanent Residency

RESPONSE TIME

Estimated processing time: Approximately 12–20 months. Once Form I-526E is approved, you either:

  • File Form DS-260 (Consular Processing) if outside the U.S., or

  • File Form I-485 (Adjustment of Status) if inside the U.S.
    Upon approval, you and your family receive a 2-year Conditional Green Card.

PHASE 3

Permanent Residency (Form I-829)

RESPONSE TIME

Estimated processing time: Approximately 24–36 months. Within 90 days before your conditional Green Card expires, you file Form I-829 to remove conditions by proving your investment created at least 10 full-time U.S. jobs. Approval grants you and your family a 10-year Green Card (renewable indefinitely).
