PHASE 1

Labor certification ETA 9098
RESPONSE TIME
Estimated processing time: Approximately 12 months. The U.S. Department of Labor certifies that no qualified U.S. workers are available for the position.

PHASE 2

Immigrant Petition I-140

RESPONSE TIME

Estimated processing time: Approximately 10 months. Your employer files an immigrant petition (Form I-140) with USCIS to confirm your eligibility for the EB-3 visa.

PHASE 1

Permanent Residency Approval

RESPONSE TIME

Consular Processing (DS-260) or Adjustment of Status (I-485) Estimated processing time: Approximately 20 months. Applicants outside the U.S. complete consular processing, while those inside apply for an adjustment of status.
